Notice to Vendors and Bidders: Phased Introduction of Mandatory OHSMS Certification for Public Construction Tenders

 

Regional Commitment to Enhanced Health and Safety Standards in Construction Procurement

The Region is committed to fostering the highest standards of health and safety across all construction projects. In alignment with this commitment and industry best practices, the Region is adopting a phased approach to making Occupational Health and Safety Management System (OHSMS) Certification a mandatory requirement for all publicly tendered construction projects.

OHSMS Certification as a formal requirement for Regional construction tenders will be required in accordance with the timeline below.

Phased Implementation Timeline:

  • Projects valued over $25 million: OHSMS Certification will be required for all new procurement processes issued on or after December 1, 2026.
  • Projects valued over $10 million: OHSMS Certification will be required for all new procurement processes issued on or after June 1, 2027.
  • Projects valued over $500,000: OHSMS Certification will be required for all procurement processes issued on or after June 1, 2028.

For clarity, in a two-stage procurement, the date the prequalification is issued will determine application of this requirement.

A bidder will be required to confirm and submit proof that it has obtained OHSMS Certification at the time of bidding. Bidders must review and comply with the submission requirements contained in the bid documents issued for each tender.

Bidders must submit a copy of one of the following documents as proof of OHSMS Certification:

  1. Certificate of Recognition (COR®) issued by the IHSA (ihsa.ca)
  2. ISO 45001 certificate issued by a certification body that is accredited by an accreditation body recognized by the International Accreditation Forum (IAF) (customerservice@iso.org or visit iso.org); and/or
  3. Any other OHSMS Certification accredited by the Chief Prevention Officer under s.7.6.1 of the Occupational Health and Safety Act (ontario.ca).

Trade Tariff Mitigation

In order to support Canadian companies and Canadian jobs, while developing longer term alternatives to diversify our supply chain, the Region of Durham is not awarding contracts to U.S. Businesses.

Language will be incorporated into our bid documents, where applicable.

“U.S. Business” means a supplier, manufacturer or distributor of any business structure (includes a sole proprietorship, corporation or other business structure) that:

i.    has its headquarters or main office located in the United States, and
ii.    has no full-time employees in Canada at the time of the applicable procurement process.

Subsidiaries would be considered to have their headquarters or main office located in the United States where the business that controls them (its parent company) has its headquarters or main office in the United States 
 

Region of Durham - Disqualified Companies:

The Region of Durham’s Purchasing By-Law 16-2020 Article 22, Disqualification of Bidders sets out provisions under which the Region may disqualify bidders from being awarded Regional contracts.

When bidding on a Regional contract, it is your responsibility to review the list of Disqualified Companies posted on the Purchasing page of Region of Durham website and ensure that you:

·  do not bid on contracts if your company is listed on the Region of Durham’s list of Disqualified Companies

·  enter into contracts only with eligible subcontractors

·  hold eligible subcontractors to the same terms and conditions as those that appear in your own contracts
